These Terms of Service ("Terms") are an agreement between you and Marcionette Media Group LLC ("Marcionette Media Group," "we," "us," or "our"), which operates the Baroque mobile application, the baroque.app website, and any related services (together, the "Service").
By creating an account, tapping "I agree," or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
IMPORTANT: These Terms contain an arbitration agreement and class action waiver (see "Dispute Resolution" below). It affects how disputes between you and us are resolved. Please read it carefully.

Baroque is a discovery and social platform for fine art. The Service lets you browse paintings and artists, rate and review works, follow artists and other users, message other users, and receive personalized recommendations based on your activity.
We are constantly developing the Service, and we may add, change, or remove features, content, or functionality at any time, with or without notice. We may also suspend or discontinue all or part of the Service at any time.
When you create an account, you agree to:
Usernames. Usernames are provided on a first-come, first-served basis, but you do not own your username. We may reclaim, change, or reassign usernames at our discretion — for example, where a username impersonates another person, infringes someone's rights, or corresponds to the name or handle of an artist.
You own the content you create on the Service — your reviews, ratings, comments, messages, profile information, photos, and anything else you post ("Your Content"). These Terms do not take that ownership away from you.
However, to operate the Service, we need your permission to use Your Content. When you post, upload, or share content on or through the Service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform and display, translate, and create derivative works of Your Content (consistent with your privacy settings, such as the private nature of direct messages and bookmarks). This license is for the purpose of operating, developing, providing, promoting, and improving the Service.
This license ends when Your Content is deleted from our systems, except that: (a) content you shared with others (such as messages, or content others re-shared) may remain visible to them; (b) content may persist in backup copies for a limited period; and (c) we may retain content as described in our Privacy Policy, including where required for legal, safety, or enforcement purposes.
You are responsible for Your Content. You represent that you own it or have the necessary rights to post it and to grant the license above, and that it does not violate the law or the rights of others.
The Service itself — including the Baroque name, logo, app, website, design, software, and the selection, curation, arrangement, and presentation of content — is owned by Marcionette Media Group LLC or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service, and you may not reverse engineer or attempt to extract our source code.
The paintings featured on the Service are, to the best of our knowledge, in the public domain. We do not claim ownership of the underlying artworks. Our catalog data, descriptions, curation, and the Service's presentation of the works are our own.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
You agree not to misuse the Service. In particular, you may not:
We may, at our discretion and with or without notice, remove or restrict access to any content that we believe violates these Terms, our policies, or applicable law, or that could harm the Service, our users, or others. We may also suspend or permanently terminate your account for any violation of these Terms, for conduct we believe creates risk or legal exposure for us or our users, or where required by law.
You may stop using the Service and delete your account at any time in the app (Settings → Delete account), or request deletion by contacting us at contact@baroque.app. In-app deletion becomes permanent after a 48-hour grace period; signing back in within 48 hours cancels it. Sections of these Terms that by their nature should survive termination — including the license to content already shared with others, disclaimers, limitations of liability, indemnification, and the dispute resolution provisions — survive termination of your account.
By creating an account, you agree that we may send you communications related to the Service — such as verification codes, security notices, and updates to our terms and policies — and that we may send you promotional and marketing communications, such as emails about new features, content, and announcements.
You can opt out of promotional communications at any time by using the unsubscribe link in any marketing email or by contacting us at contact@baroque.app. Service-related communications are a necessary part of the Service, and you may not opt out of them while you maintain an account.
The Service may contain links to third-party websites, services, or content — for example, links other users add to their profiles. We do not control and are not responsible for third-party websites, services, or content, and linking to them does not imply our endorsement. Your use of any third-party service is at your own risk and subject to that third party's terms and policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT — INCLUDING CATALOG INFORMATION ABOUT ARTWORKS AND ARTISTS — IS ACCURATE, COMPLETE, OR CURRENT.
WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ON OR OFF THE SERVICE, OR FOR ANY CONTENT POSTED BY USERS. YOU USE THE SERVICE AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, MARCIONETTE MEDIA GROUP LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Marcionette Media Group LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND LIMITS THE WAYS YOU CAN SEEK RELIEF.
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by emailing us at contact@baroque.app with a description of the dispute. We will try to resolve it with you. If the dispute is not resolved within 30 days of your email, either of us may begin arbitration as set out below.
Arbitration agreement. You and Marcionette Media Group LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. The arbitrator — not a court — will decide all disputes, except that either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court for infringement or misuse of intellectual property rights.
Class action waiver. YOU AND WE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) must be severed from arbitration and brought in court.
Opt-out. You may opt out of this arbitration agreement and class action waiver by emailing contact@baroque.app within 30 days of first accepting these Terms, with your username and a clear statement that you want to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms.
Fees. Payment of AAA filing, administration, and arbitrator fees will be governed by the AAA's rules. The arbitration will be conducted in English and, unless you and we agree otherwise, will take place by videoconference or, if an in-person hearing is required, in the county where you reside or another mutually agreed location.
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, without regard to its conflict of laws principles, except that the arbitration agreement above is governed by the Federal Arbitration Act. For any claim not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. If we make material changes, we will notify you — for example, through the Service or by email — before the changes take effect. Your continued use of the Service after the updated Terms take effect means you accept them. If you do not agree to the updated Terms, you must stop using the Service and delete your account. The "Effective date" at the top of these Terms tells you when they were last revised.
